DEFINITIONS

In these General Terms and Conditions of Sale, the following terms shall have the meanings defined below:
– “The Company”: AZZO CREATION
– “The Client”: Any natural person who, when purchasing from the site www.azzo.fr, acts on their own behalf or as a representative of a legal entity they are authorized to represent
– “Order Form”: A document indicating the characteristics of the products ordered by the Client, which must be confirmed by a “double click” to be binding
– “Order”: The act by which the Client agrees to purchase products and/or services and the Company agrees to deliver and/or provide them
– “Product”: Goods sold or services provided by the Company
– “Double click”: The action that validates the Order Form by the Client. An order is not final until confirmed by the Client, either by ticking a box to accept the terms or by confirming the order message.

PURPOSE

These terms govern the contractual relationship between AZZO CREATION and the Client when purchasing from www.azzo.fr.

Both parties agree these terms exclusively apply, replacing any previous versions available on the site.

They can be printed and saved by the Client.

AZZO CREATION reserves the right to modify the terms at any time by publishing a new version on the site. The applicable terms are those in force at the time the order is confirmed.

PRODUCTS

The products covered are those listed on www.azzo.fr.

Product descriptions appear on the website.

Photos and text are non-contractual and subject to change at any time.

Products are available as long as they are displayed online and while stock lasts.

If a product becomes unavailable after payment, the Company will offer an equivalent replacement, store credit, or a refund within 30 days.

PRICING

Product prices on www.azzo.fr are listed in Euros including VAT, but excluding shipping, handling, and delivery fees.
Shipping fees are indicated before the order is confirmed.

For orders outside mainland France, you are considered the importer. Customs duties, local taxes, import charges, or state taxes may apply and are the sole responsibility of the Client.

AZZO CREATION reserves the right to change prices at any time, but the price charged will be the one in effect when the order is validated.

Products remain the property of AZZO CREATION until full payment is received.

Important: Once the Client physically receives the products, all risks of loss or damage are transferred to them.

PAYMENT TERMS

The total order amount is due immediately upon confirmation.
Payment is made by credit card and secured with SSL encryption.

The Client must provide their card number, expiration date, and CVV. A verification code may also be required.

ORDERS

Placing an Order:
The ordering process is available only in French.
The Client selects products and adds them to a virtual cart.
After finalizing selections, the Client clicks “VALIDER MES ACHATS”.
They must either log in or create an account.
Then, they review the Order Form and correct any errors before confirming.

By accepting the general terms and clicking to confirm, the Client accepts the offer irrevocably.
The Company will not be bound except as defined in the "Right of Withdrawal" section.
Once confirmed, the Client is redirected to the secure payment process.

Order Fulfillment:
The order is processed once payment is authorized.
If the payment is denied, the order will not be processed.
The Client will receive email confirmation of acceptance and payment.

AVAILABILITY

Products are available as long as they appear online and while stock lasts.
In case of unavailability after ordering, the Client will be notified by email or phone, and the order will be canceled and refunded.

DELIVERY

Delivery Fees:
Deliveries are made by SO COLISSIMO (La Poste).
Shipping in mainland France is free from €39 in purchases.
Home delivery with signature: within 3 working days.
Pickup point delivery: 3 working days.

Delivery Process:
A signature may be required for home delivery.
Clients can track their packages at www.colissimo.fr using the tracking number.

Delays:
Orders are processed within 2 working days.
Shipping takes 48 to 96 hours (excluding weekends and holidays).

The Company is not responsible for delays caused by external disruptions (strikes, weather, etc.).
In case of repeated failed delivery attempts due to the Client being unavailable, additional fees may apply.

If delivery is not made within 30 days, the Client can request a full refund, which will be issued within 30 days.

NON-CONFORMING DELIVERY

If a package is damaged, partially missing, or incorrect, the Client must note it on the delivery slip and either refuse delivery or report the issue.

They must inform the Company within 48 hours by email (service.client@azzo.fr) or phone (+33 4 81 76 16 46), and photos may be required.
Refunds for canceled orders will be issued within 30 days.

REFUND & EXCHANGE POLICY

Clients must request exchanges or refunds within 7 days of receiving their order by contacting service.client@azzo.fr or +33 4 81 76 16 46.

Products must be returned unused, in their original packaging.
Refunds will be made by card, transfer, or check after approval.

Shipping costs are covered by AZZO CREATION, but return costs are the Client's responsibility (except for defective products).

Refunds are issued within 30 days of receiving the returned goods.
For exchanges, processing takes up to 8 working days.

RIGHT OF WITHDRAWAL

According to article L.121-21 of the French Consumer Code, the Client has 14 days from receipt of goods to withdraw.

Returns must include original packaging, accessories, and instructions. Damaged items are ineligible.
Return shipping is the Client's responsibility.

AZZO CREATION will issue a refund within 14 days of receiving the withdrawal notice.

WARRANTIES

Commercial Warranty:
In case of defects, the Client has 7 days from delivery to return the item with proof of purchase.

Some products (e.g., electrical items) include a 1-year manufacturer’s warranty. The Client must return the item at their own cost for repair or exchange.

Legal Warranties:
All products are covered by legal guarantees of conformity and hidden defects (articles 1641+ of the French Civil Code).

Claims should be made by email or phone.

• Article L211-4: The seller must deliver a product conforming to the contract.

• Article L211-5: The product must:

  • Be suitable for its intended use

  • Match the description and quality promised

  • Have qualities expected based on marketing or labeling

RETURNING GUARANTEED PRODUCTS

Items must be returned with all original elements (packaging, accessories, manuals), invoice, warranty card, and return form.
Return shipping will be refunded with proof of cost.

CLAIMS

All claims should be sent to: service.client@azzo.fr during business hours.

LIABILITY

Products comply with French regulations.
AZZO CREATION is not responsible for non-compliance with foreign laws.
Clients are responsible for ensuring local legal compliance.

AZZO CREATION is not liable for damages caused by improper use.
AZZO CREATION is also not liable for internet-related issues (interruptions, viruses, etc.).

PERSONAL DATA

As per law n°78-17 of January 6, 1978, client data is required for order processing and billing.
Data processing has been declared to the CNIL.

Clients have the right to access, rectify, or delete their data by writing to:

INTELLECTUAL PROPERTY

The site content is the property of AZZO CREATION and protected by French and international intellectual property law.

No reproduction or reuse (even partial) is allowed without prior written permission.
Unauthorized reproduction constitutes infringement.

ARCHIVING

Order forms and invoices are archived in a reliable and durable medium in accordance with article 1348 of the French Civil Code.

Digital records will be considered proof of communications, orders, and payments.

GOVERNING LAW – JURISDICTION

This contract is governed by French law.
In the event of a dispute, the parties will seek an amicable resolution. If not possible, the French courts will have exclusive jurisdiction.
